They assess borrowers' financial situations, recommend appropriate loan products, and guide clients through the mortgage application process. Many people refer to the individual MLO as a mortgage loan officer or mortgage broker.
An MLO (Mortgage Loan Originator) license is required by Florida state law for anyone who takes residential mortgage loan applications or negotiates residential mortgage loan terms in Florida. This requirement is mandated by the SAFE Act and Florida state regulations to ensure consumer protection and industry professionalism. All mortgage license applications, amendments and renewal filings must be filed through Nationwide Multistate Licensing System and Registry (NMLS).
Under Florida Statute 494.00115, exemptions apply to:
- Registered loan originators operating exclusively for depository institutions (banks or credit unions).
- Employees of government agencies or quasi-governmental entities (Fannie Mae, Freddie Mac).
- Licensed Florida attorneys negotiating terms as an ancillary matter to client representation.
- Individuals involved solely in credit extensions relating to timeshare purchases.
FL MLO Pre-Licensure Education requires completion of 22 hours of an NMLS approved pre-licensure education course, of which a minimum of 2 hours shall cover the provisions of Florida Law and Rules. If you are a new MLO in Florida, start by registering for your NMLS ID number, completing the required training hours for Florida, and passing the SAFE MLO Exam. You can then apply by taking the following actions in your NMLS account:
- Submit to an FBI criminal background check
- Provide fingerprints to NMLS
- Authorize the Registry to obtain an independent credit report
- Pay all required fees
- Activate your license through a mortgage lender sponsorship
Yes. Florida OFR requires you to upload a PDF document in NMLS under Verification of High School Education. The document must state your name, NMLS ID, high school name, and the date your diploma or GED equivalent was received. (An actual physical copy of the diploma is not required).
Florida requires two separate background check authorizations:
- FBI Criminal Background Check: Requested and authorized directly through the NMLS portal.
- State Criminal Background Check: Fingerprints submitted to an FDLE-approved Live Scan Service Provider using ORI Number: FL737111Z.
Yes. Applicants must authorize an independent credit report via TransUnion inside the NMLS. Important: If you have a security freeze on your TransUnion credit profile, you must perform a global lift before submitting your MU4 filing, or the application submission will be voided.
Yes. Florida permits remote operations provided your sponsoring employer maintains supervisory policies, secure encrypted VPN access, device security with remote-wipe ability, and complies with data privacy laws. In-person client meetings cannot take place at an unlicensed home location.
An independent loan processor contracting with multiple mortgage brokers or lenders must be licensed as a loan originator under Chapter 494, F.S., and file Form OFR-494-13 (Declaration of Intent to Engage Solely in Loan Processing) with the Florida Office of Financial Regulation.
The training is just 22 hours long and the training can be completed in as little as four days. The NMLS requires all students to finish the National 20-hour course in 14 days or less. The required 20 hours of pre-licensing education typically includes 3 hours of federal law, 3 hours of ethics, 2 hours of non-traditional mortgage lending, and 12 hours of electives.
The typical timeline for a Florida MLO application to be processed is:
- Pre-licensing education: 14 days or less (complete in as little as 4 days full-time).
- SAFE MLO test preparation & passing: 1 to 2 weeks.
- Application processing: 2 weeks on average after status reaches Pending-Review.
- Total time: 6 to 14 weeks, depending on your preparation and state processing volume.
